(International Trade Finance and Letter of Credit) |
In international commercial transactions, the issue how the contract parties finance their transaction provides undeniable practical and legal importance, considering the financial risk arising thereof. Various payment instruments have been utilised. Among them, documentary credits, also called letter of credits, and independent guarantees have played major roles as effective financial instruments since they reconcile different needs of the contract parties in relation to the time of payment. In order to entertain the stable and strategic performance of international commercial transactions, an in-depth analysis of these instruments is essential. In that respect, this course aims at analysing documentary credits and autonomous guarantees for the purpose of providing expert knowledge required to be an expert in international commercial transactions. In analysing a documentary credit, its basic mechanism and principles will be studied through careful analysis of the UCP, which universally applies to most of documentary credits, its supplementary rules, such as URR, ISBP and eUCP, and case laws of different jurisdictions. With respect to independent guarantees, various international rules and national laws will be analysed. |

As its main contents, it deals with various practical procedures related to the transportation of goods, such as the types and procedure of international transportation, such as land transportation, air transportation, multimodal transportation, etc., as well as the rights and obligations of the transportation parties, with a focus on maritime transportation. To this end, this course discusses recent issues such as concluding contracts of affreightment or charterparty as part of maritime transport, air transport, multimodal transport by container ship, and related international conventions. |

(Open Eeconomy Macroeconomics) |
This course provides a theoretical framework that are relevant to the topic of the determination of current account and international business cycles. The first part of the course studies the determination of cross-border capital movement and resulting current account in a framework of microeconomics. This part also evaluates the effect of temporary and permanent economic shocks on international lending and borrowing, providing implications for dynamics and sustainability of current account imbalances. Next, the course moves to the theory of international business cycles to understand the mechanism of the international transmission of country-specific shocks. |

Involving in international commercial transactions has meant for the contract parties in practice, being exposed to inevitable commercial risks arising out of their commercial characteristics, trading with foreign parties. Especially, the risk is likely to be increased where the transaction requires international movement of goods. This is because, as a significant number of sea-going vessels are lost or damaged, the vessels as well as the cargoes they carry are often damaged and lost, causing significant financial loss to shipowners and traders. With that respect, understanding of risks arising out of international transactions and insurance which is the means of providing financial protection against those risks is essential to entertain stable international commercial transactions. Therefore, this subject, Global risks and insurance, is aiming at providing relevant legal and practical knowledge of insurance to students. Special note must be given that, in this subject, English law and practice of insurance would be analysed because, firstly, insurance practice, especially in relation to marine insurance, is based on English law; secondly, the London insurance market is of major international importance both in the direct provision of insurance and in the reinsurance of risks underwritten by insurers in other jurisdictions around the world; thirdly, many shipowners’ mutual associations, major providers of liability insurance, also employ English law. |
